National Indigenous People Forum 2010


Right to Consultation and Participation in the Development Process on IP Territories


Phnom Penh, November 25-26, 2010

  1. I.        Background

The indigenous people forum is an opportunity for all indigenous people from 15 different provinces to meet and share their concerns, challenges, and experiences with each others, and then to find the relevant recommendation and strategies to overcome those concerns and issues that includes intervention from governments and other relevant national and international organizations.

With support and assistance from different organizations so far, the indigenous people forums have been conducting every year by the groups of indigenous people themselves from all the 15 different provinces. The forums were conducted in different places with different topics up on the consultation of the indigenous people themselves as the following:

Laws and Strategies to Protect Indigenous Peoples

Basically, resulted from these forums Indigenous Minority Rights Project of NGO forum was commenced, Indigenous Rights Active Member (IRAM) was established, Indigenous Program of ILO was commenced, Policy on Communal land registration procedure and Sub decree on the procedure of communal land registration were adopted and promulgated, Nation Policy on Indigenous Peoples Development in Cambodia was adopted, and the UNDRIP was voted and adopted by RGC. In addition, Indigenous Peoples Working Group (IPWG) members in 15 provinces were selected by IRAM, IP community leaders in 11 provinces were selected by IRAM and IPWG and many indigenous people have been aware of many other relevant legal instruments related to their rights.

Particularly for 2010, with consultation of the indigenous peoples from IRAM, OPKC, HA, and CIYA, the topic was proposed to be “Right to Consultation and Participation in the Development Process on IP Territories” and conducted in Phnom Penh. The reason behind this topic was that the indigenous people have been impacted by the any economic concessions when they were not able to fully participate in the process of the consultation. They believe that the government has ignored their participation roles in the consultation process even though those rights have been stipulated in both national and international laws. They also observed that the government never give them clear information and support for enable them to participate in the process of their development projects.

  1. II.      Overall Objective

As an impact from this forum, the indigenous peoples would like to see their community lands secured through the full intervention of the government that includes the entitlement and respect of the indigenous peoples’ right to consultation and participation in the process of the development and land and natural resources management.

Specific Objectives

The indigenous people meet and discuss to share all information and experiences with each others as well as the government delegations.

With the dialogue between the indigenous people participants and the government delegation, they will reflect the laws and policies related to the indigenous peoples with the focus on participation and consultation process and will find recommendations and interventions for better implementation in term of securing the indigenous peoples’ lands and natural resources. In addition this year, all partners will take this opportunity to review what has been done with the IP forum so far and to evaluate those who made the practical impacts.

  1. III.    Expected Outputs
    1. All information, issues, and experiences of all participants have been shared with each others;
    2.  IP forum plan, method, and processes conducted so far reviewed and their impacts evaluated;
    3. The rights of indigenous peoples in participation and consultation and the government intervention have been found in different national and international laws and policies;
    4. The issues of indigenous peoples related to the consultation in the development process they are facing today  acknowledged and considered by the government delegations; and
    5. Result of this forum documented and given to the governments, donors, and other relevant organizations for their action.

The follow up plan:

  1. The report of this forum must be finalized one month after the forum by CIYA (Khmer and English versions).
  2. The recommendation resulted from this workshop will be written into a request and submitted to the relevant ministries/departments, donors, private sectors, and other stakeholders. These also must be widely published in the mass medias.
  3. NGO forum is responsible for disseminating to all stakeholders, communities, and government.
  4. The result of this forum will be follow up by IRAM and IPNN reflection meeting. It is also will be reflected by the action plan of the line ministries/departments by an assessment team (CIYA, OPKC, IRAM, HA).

The gender issue: Is there any different issues raised between women and men? What are the roles of women and men in the consultation in the development process? How is the participation between men and women?

  1. IV.    Venue: This public forum is requested to be conducted in Phnom Penh, CJCC, IFL, closed by Royal University of Phnom Penh.


  1. V.      Participants: The total participants is expected to be up to 142  from different places as the following:
